Terms of service

These Terms of Service ("Terms") govern your use of the Lucentis online store and every purchase you make from it. The store is operated by Lucentis LLC, a New Mexico limited liability company with its business address at 1401 Pennsylvania Ave, Suite 102, Wilmington, DE 19806, USA ("Lucentis," "we," "us"). By using the store or placing an order, you agree to these Terms. If you don't agree, please don't use the store.

1. Who can shop here

You must be at least 18 years old and able to enter a binding contract to place an order. We sell to consumers with shipping addresses in the United States. We don't ship outside the U.S. at this time.

2. Our products

We sell comfort and enrichment goods for dogs: beds, cushions, blankets, feeding and hydration gear, harnesses, leashes and travel accessories. We do our best to describe each product accurately, including materials, dimensions and care instructions. Colors may look slightly different on your screen than in person, and dimensions can vary by a small amount from the listed size.

Our products are everyday goods for dogs. They are not medical or veterinary devices, and nothing on our store is veterinary advice. If your dog has a health concern, please talk to your veterinarian. Supervise your dog with any new product, check it regularly for wear, and stop using anything that becomes damaged.

3. Prices and payment

• All prices are in U.S. dollars (USD) and exclude sales tax and shipping, which are shown at checkout before you pay.
• The price you pay is the price displayed at checkout when you place the order. Prices may change at any time, but changes don't affect orders already placed.
• Your payment method is charged when you place your order. Accepted payment methods are listed in our Payment Methods page.
• Discount codes are limited to one per order, have no cash value and can't be applied after an order is placed.

4. Pricing errors

Despite our care, a product may occasionally be listed at an incorrect price or with incorrect information. If the correct price is higher than the price displayed, we'll contact you before shipping and give you the choice to pay the correct price or cancel for a full refund. If a listed price is clearly a mistake, we may cancel the order and refund you in full, even after you've received an order confirmation. We'll always tell you why.

5. Orders and acceptance

An order confirmation email means we've received your order, not that we've accepted it. Our acceptance happens when we ship the item to you. We may decline or cancel an order, in whole or in part, when:

• An item is out of stock or discontinued
• A price or product description was in error
• The order can't be verified, appears fraudulent or violates these Terms
• The shipping address is outside the area we serve

If we cancel an order after you've paid, you're refunded in full to the original payment method. We may also limit quantities per order or per customer.

6. Shipping and risk of loss

Shipping costs, delivery estimates and the areas we serve are described in our Shipping Policy, which is part of these Terms. Delivery times are estimates. Title and risk of loss pass to you when the carrier delivers the package to the shipping address you provided. If a package is lost or damaged in transit, our Shipping Policy explains how we'll replace it or refund you.

7. Returns and refunds

Our Return and Refund Policy is part of these Terms. In summary: you may return unused items in their original packaging within 30 days of delivery; return shipping is paid by you unless the item is defective or we made an error; refunds go to the original payment method within 5–10 business days after we receive the return; personalized items can't be returned.

8. Promotions

Promotions, discount codes and free shipping thresholds are subject to the conditions stated with them. Unless stated otherwise, they can't be combined, don't apply to previous orders and can be ended by us at any time. Ending a promotion never affects an order that was already placed.

9. Intellectual property

The Lucentis name, the "Dog Comfort Goods" descriptor, our curled-dog mark, our logo, product photography, illustrations, text and the design of the store are owned by Lucentis LLC or used under license. You may browse the store and print pages for your own personal, non-commercial use. You may not copy, reproduce, scrape, republish or use any of our content for commercial purposes without written permission. Product names and trademarks of manufacturers belong to their respective owners.

10. Your account, reviews and other content

If you create an account, keep your login private and tell us if you suspect it has been used without permission. You're responsible for keeping your contact and shipping details accurate.

When you submit a review, photo or comment, you give us a non-exclusive, royalty-free, perpetual license to use, display and edit it in connection with our store and marketing, with your first name and last initial. Reviews must be honest, based on your own experience, and free of anything illegal, offensive or infringing. We don't publish fake reviews and we don't pay for reviews. We may remove content that violates these rules.

11. Acceptable use

You agree not to use the store to break any law, to interfere with its operation or security, to place fraudulent orders, to use bots or automated tools to buy or scrape, or to impersonate anyone. We may restrict or terminate access to anyone who violates these Terms.

12. Third-party links and services

Our store may link to third-party sites, such as a manufacturer's care guide or a carrier's tracking page. We aren't responsible for their content or their privacy practices. Payments, hosting and shipping are provided by third parties described in our Privacy Policy.

13. Disclaimer of warranties

Where a manufacturer offers a warranty on a product we sell, we'll point you to it, and our own 30-day return policy applies to every item. Beyond that, and to the fullest extent permitted by law:

The store and its content are provided "as is" and "as available," without warranties of any kind. Except for the express commitments in these Terms and our policies, we disclaim all implied warranties, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We don't warrant that the store will be uninterrupted or error-free.

Some states don't allow the exclusion of implied warranties, so parts of this section may not apply to you. Nothing in these Terms limits rights you have under applicable consumer protection laws.

14. Limitation of liability

To the fullest extent permitted by law, Lucentis LLC and its members, managers and employees won't be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the store or any product purchased from it. Our total liability for any claim relating to an order is limited to the amount you paid for that order.

Some states don't allow limits on liability for certain damages, so parts of this section may not apply to you. Nothing here limits liability that can't be limited under applicable law, including liability for personal injury caused by a defective product where such liability can't be excluded.

15. Indemnification

You agree to defend and hold Lucentis LLC harmless from claims, losses and reasonable legal fees arising from your violation of these Terms or your misuse of the store or a product, except to the extent caused by our own negligence or breach.

16. Governing law and disputes

These Terms and any dispute relating to the store or an order are governed by the laws of the State of New Mexico, where Lucentis LLC is organized, without regard to its conflict-of-law rules, and by applicable U.S. federal law. Consumer protection laws of the state where you live may also give you rights that these Terms don't override.

If you have a problem, please email us first. Most issues can be resolved within a few days. If we can't resolve a dispute informally within 30 days, either of us may bring a claim in the state or federal courts located in New Mexico, and you agree to their jurisdiction. If you're a consumer, you may also bring a claim in the small claims court of the county where you live.

17. Changes to these Terms

We may update these Terms from time to time. The effective date at the top shows the latest version. Changes apply to orders placed after the change; the Terms in effect when you placed an order continue to apply to that order.

18. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision isn't a waiver of it. These Terms, together with our Shipping, Return and Refund, Privacy and Payment Methods policies, are the entire agreement between you and us regarding the store. You may not assign your rights under these Terms; we may assign ours to a successor of our business.
